2nd lawsuit against Alec Baldwin claims the “Rust” actor fired his pistol “deliberately and for no reason.”

Hollywood actor Alex Baldwin had no reason to shoot the pistol that led to the fatal shooting of cameraman Halina Hutchins on the set of Rust last month, according to a new lawsuit filed Wednesday.

Scriptwriter Mamie Mitchell, who called an ambulance after Baldwin shot Hutchins, filed a lawsuit (pdf) with the Los Angeles County Superior Court, accusing the actor of firing a pistol for no good reason.

“Alec Baldwin deliberately cocked the trigger and fired a loaded pistol for no good reason or excuse, even though the upcoming scene to be filmed did not require cocking and firing a firearm,” Mitchell said in the lawsuit. “Mr. Baldwin chose to play Russian roulette with a loaded gun without checking it and asking for a gunsmith.”

“There was nothing in the script about gun shots by the defendant Baldwin or any other person,” the lawsuit says.

Hutchins, 42, was fatally wounded on October 21 when actor Baldwin, 63, pointed a 45-caliber Long Colt revolver towards cameraman and director Joel Sousa during a rehearsal for a shootout scene. The revolver fired the suspected live round, killing Hutchins and wounding 48-year-old Sousa.

The latest lawsuit marks a second lawsuit against Baldwin and the Rust producers. Lighting chief Serge Svetnoy also sued the actor and film producers for “gross negligence” in a lawsuit (pdf) filed earlier this month with the Los Angeles Supreme Court.

Svetnoy’s claim requires an unspecified amount of compensation and general damages to each of the defendants.

Mitchell, who claims to be in the line of fire when the gun was fired, argues that the assault, willful infliction of emotional distress and willful harm are seeking indefinite damages in a lawsuit.

The script director said she was sitting less than four feet from the actor when she suddenly fired a pistol, creating a “shocking and deafening sound” “unlike anything she had ever heard in her life.”

The lawsuit alleges that the incident scared Mitchell and scared her for her life.

“Alec Baldwin should have assumed that the gun in question was loaded if and until he showed him or verified that it was not loaded,” Mitchell said. “He had no right to rely on some alleged statement by the assistant director that it was ‘cold steel’. Mr. Baldwin can’t hide behind the assistant principal trying to justify the fact that he didn’t check the gun himself. “

“Alec Baldwin didn’t check to see if the firearm was loaded without good reason,” the lawsuit says, and Baldwin is also accused of disregarding gun safety rules on set.

“The fact that live ammunition was allowed on set, that weapons and ammunition were left unattended, that the weapon was handed over to Mr. Baldwin by an assistant director who had nothing to do with it, the fact that the security bulletins were not made public or ignored, coupled with the fact that the scene in question did not require firing a pistol at all, makes this a case where injury or death was much more than just an opportunity, ”the lawsuit says. “That was the likely outcome.”

Baldwin said he was heartbroken and was cooperating with law enforcement. Production company Rust Movie Productions is conducting its own investigation.

Lawyers representing the film’s gunsmith Hannah Gutierrez Reed on November 3 argued that the “disgruntled and unhappy” man may have intended to “sabotage” the installation by replacing empty cartridges with live rounds.

Officials investigating the deadly shooting have not ruled out charges against anyone involved.
