The Fifth National Criminal Appeals Chamber confirmed the preventive detention for 30 months against Sada Goray Chong and Mauricio Fernandina Arbulú for the alleged crime of aggravated conspiracy and others harmful to the State.
Meanwhile, the court revoked the termination of the resolution issued by judge Raúl Justiniano, which also imposed 30 months of preventive detention against Roger Gavidia Johanson, and Pedro Arroyo Marquina, reforming it for a repressive appearance with compliance with the rules of conduct.
Each of them must pay a financial guarantee of S/30,000, which must be deposited in the Banco de la Nación within 10 business days. Under the warning in the case of non-compliance with any of the imposed rules of conduct, the right to withdraw the measure and dictate preventive prison, before the respective requirements. Their immediate release is ordered as long as they do not register an arrest warrant, preventive detention, and/or effective custodial sentence issued by a competent authority.
On August 2, the Public Ministry appealed to the Eighth Preparatory Investigation Court for preventive detention to be increased from 30 to 36 months against all those involved, who are being investigated for the alleged crime of aggravated conspiracy committed within the framework of a criminal organization.
Let’s remember that the Special Team of Prosecutors against the Corruption of Power investigations began after businessman Sada Goray confessed to the Public Ministry that he made effective payments of more than S/4 million to Salatiel Marrufo, former head of the Cabinet of Advisors of the Ministry of Housing so that Marka Group the company got contracts during the government of Pedro Castillo.
Mauricio Fernandina is involved in this case. In May he accepted a sincere confession and acknowledged that he was the mediator of the bribes paid by Sada Goray to Salatiel Marrufo.
According to the journalist’s version, Goray’s driver left him an order on October 14, 2021, at his apartment. Fernandina said that Goray was satisfied because the Government of Pedro Castillo appointed three of his recommendations as directors of the Mivivienda fund: Pedro Arroyo, Gonzalo Arrieta, and Roger Gavidia.
With this, Goray has hope that the Ministry of Housing will benefit him with an affordable property construction project.
