America: Supreme Court increased gun rights

WASHINGTON ( Associated Press) — In an expansion of gun rights in the United States after the mass shootings, the Supreme Court ruled Thursday that Americans have the right to carry guns in public for self-defense, a decision that almost certainly Will lead to more people being legally armed.

The ruling was issued at a time when Congress and the state were debating a gun control bill.

About a quarter of the US population lives in those states, which are expected to be affected by the decision, which scrapped New York state’s gun law. The first High Court ruling on firearms in more than a decade came by a 6–3 vote, with conservative and liberal dissent in the majority.

Across the street from the courthouse, lawmakers on Capitol Hill are moving quickly to pass a gun law inspired by the recent mass shootings in Texas, New York and California. The senators cleared the way for the measure, modest in scope but still the most relevant in decades.

Also on Thursday, in clear evidence of the deep division in the country over the issue, the sister of a 9-year-old girl killed in a massacre at an elementary school in Uvalde, Texas, begged state lawmakers to pass legislation on gun control. The Republican-controlled legislature has weakened restrictions on firearms over the past decade.

President Joe Biden said in a statement that he was “deeply disappointed” by the Supreme Court’s decision, which is “contrary to common sense and the Constitution, and we should all be deeply concerned.”

Biden urged states to pass new laws in this regard. “I encourage Americans across the country to raise their voices on gun safety. Lives are at stake,” he said.

The Supreme Court decision struck down a New York law that requires people to demonstrate a special requirement to carry a firearm in order to be licensed to carry it in public. The judges said the requirement violated the Constitution’s Second Amendment right to “keep and bear arms.”

Justice Clarence Thomas wrote for the majority that the Constitution “protects the right of a person to carry a firearm for self-defense outside the home.” He said this right is not a “second-class right”. “We are not aware of any other constitutional rights that a person can exercise only after demonstrating to government officials that they have a special need.”

California, Hawaii, Maryland, Massachusetts, New Jersey and Rhode Island have laws similar to those of New York, which are expected to be appealed after the High Court’s decision.

New York Governor Cathy Hochul, a Democrat, said the ruling comes at a particularly painful time as the state mourns the deaths of 10 people in a shooting at a Buffalo supermarket. “This decision is not just reckless. This is objectionable. This is not what the people of New York want,” he said.

Gun control groups described the ruling as a significant blow. Michael Waldman, president of the Brennan Center for Justice and expert on the Second Amendment to the Constitution, which guarantees gun rights, wrote on Twitter that the decision could be the “greatest expansion of firearms rights” by the United States. Some Republican lawmakers praised the decision. Tom King, president of the New York State Rifle and Pistol Association that filed the suit, said he was relieved.

“The legal and legitimate gun owner in New York State will no longer be bothered by laws that have nothing to do with the safety of people and that will do nothing to make them safe,” he declared. “And maybe now we will start taking action against the perpetrators and the perpetrators of these heinous acts.”

The Supreme Court last issued a big gun decision in 2010. In that decision and a 2008 ruling, judges established a nationwide right to have a gun in the home for self-defense. This time the matter for the court was about the permission to carry weapons outside the house.
