Arizona AG sues Biden administration over COVID-19 vaccine mandate

15 September (WNN) — Arizona Attorney General Mark Branovich has filed a lawsuit against the Biden administration over its COVID-19 vaccine mandate for companies with more than 100 people, calling it unconstitutional and an attack against federalism.

In a statement on Tuesday announcing the lawsuit, the Republican attorney general said the new measures President Joe Biden unveiled last week violated the Constitution as the federal government forced people to get the COVID-19 vaccine. can’t.

“The Biden administration is once again flouting our laws and precedents to advance its radical agenda,” Branovich said. “There can be no serious or scientific discussion about how to stop the spread of COVID-19 that doesn’t start at our southern border.”

The lawsuit was announced days after Biden unveiled his COVID-19 action plan, called Path Out of the Pandemic, which included six pillars for tackling the virus.

One of those pillars is to increase vaccination rates by directing Labor’s Occupational Safety and Health Administration Department to develop a rule that requires all employers with 100 or more employees to ensure that their workforce is fully covered. Get vaccinated.

The lawsuit accuses the new measure of violating the Constitution’s equal protection clause because it favors “aliens who have illegally entered the United States” on actual US citizens.

In the lawsuit, Branovich says the policy is unconstitutional because the Department of Homeland Security makes vaccination optional for people who enter the country through irregular migration at the US southern border, but mandates that US citizens be shot.

“In his effort to whether or not to illegally incorporate people into this country, he is basically discriminating against American citizens,” Branovich said in a call to reporters, adding that there will be more lawsuits against the measure.

Branovich told reporters that the lawsuit is about federalism and constitutional principles because the mandate takes away their health-related powers, while discriminating against US citizens in favor of those entering the country through irregular migration.

“The Biden administration has no authority under the Constitution to mandate COVID-19 vaccines. Period,” he said. “This is a colossal effort by a federal department that shows big government at its worst, not at its best.”

He called the mandate “never attempted by any administration in the history of our republic” and a continuation of the Biden administration’s “attack” on the Constitution.

“It’s just the opening salute,” he said. “And there will be action.”

Asked why sue if the mandate can’t actually be implemented, Branovich said there’s “a lot of uncertainty and confusion” about what the president can do, he wants to prevent the mandate from going in the meantime. will do all that he can with effect.

“I think once the rules are in place, there will be additional opportunities based on what the Biden administration has said, but I think at this point in time we have to stop these executive orders from going forward. There is a way and a vehicle,” he said. “This is the first attempt to try and stop the Biden administration’s overreaction on these COVID rules.”
