In October 2022, bakery distributor drivers Bimbo Bakeries USA and Bimbo Meat Bakeries Distribution filed a lawsuit in the US District Court for the District of Vermont, contending that they should receive back pay because they were falsely classified as independent contractors, instead of being employees of the company.
Bimbo Bakeries then filed a lawsuit against the directors, seeking restitution of any money owed to workers while the companies were operating.
The US Department of Labor requested that the Vermont federal court allow the department to intervene and seek dismissal of the Bimbo Bakeries lawsuit in the USA.
Bimbo Bakeries USA is owned by Grupo Bimbo Mexicano, under the direction of Daniel Servitje, which makes 11,000 distribution routes, twelve brands, including Arnold, Artesano, Ball Park, Bimbo, Boboli, Brownberry, Entenmann, Parva Bites, Marinela, Mrs. Baird’s, Oroweat, Sara Lee, Stroehmann and Thomas.
The Fair Labor Standards Act, by the US Department of Labor, Wage and Hour Division, requires that most workers be paid at least the federal minimum wage for hours worked and overtime.
This law also gives employers the right to sue wage-earning businesses and to sue private workers in federal court without retaliation from employers.
