Clarence Thomas: Now the Supreme Court can limit marriage equality and contraception

If Clarence Thomas gets his way, abortion rights are only the beginning of what must fall.

On Friday, a conservative Supreme Court justice wrote a concurring opinion in Dobbs v. Jackson Women’s Health Organization, which abolishes the constitutional right of Americans to have an abortion.

Thomas said judges should also review other cases that rely on the right to privacy, especially cases defending access to contraceptives and same-sex relationships.

“In future cases, we must review all significant due process precedents of this Court, including Griswold, Lawrence and Obergefell,” Thomas wrote.

These cases have long been on the radar of conservatives, who ridicule the idea that there is a constitutional right to privacy. However, in his opinion for Friday’s majority, Judge Samuel Alito said that Dobbs’ result does not at all mean that the Conservatives want to push for those decisions. He even ridiculed the dissent of liberal judges who drew comparisons between “the right to abortion and the rights recognized in Griswold (contraception), Eisenstadt (the same), Lawrence (sexual relations with members of the same sex) and Obergefell (same-sex marriage). )”.

“Perhaps this is done in order to fuel unfounded fears that our decision will jeopardize these other rights,” he added.

But, as Thomas’ consent makes clear, this fear is very rooted in reality.

Jim Obergefell, the lead plaintiff in the same-sex marriage case and currently a candidate for the Ohio House of Representatives, has strongly criticized Thomas and his comments about marriage equality.

“Clarence Thomas is a Supreme Court judge appointed by the people, not a supreme deity,” the statement said. “Millions of loving couples who have the right to marriage equality to create families of their own do not need Clarence Thomas to impose his individual perverse morality on them. If you want to see an error in judgment, Clarence Thomas, look in the mirror.

A number of Republican politicians are already following the same path as Thomas, saying they would like cases like Griswold and Obergefell to be dropped and considering legislation that could lead to bans or restrictions on contraception.
