Colombian government supports request to annul abortion decision

BOGOTÁ ( Associated Press) — The Colombian government has given a legal concept, backing requests by a dozen citizens against a Constitutional Court ruling that recently outlawed abortion up to the 24th week of gestation.

Colombia was the last country in the region to make a concrete decision on abortion and is one of the most resilient countries with regard to voluntary interruption of pregnancy. The Colombian government’s conception becomes known when organizations defending abortion are concerned about the implications of a decision by the United States Supreme Court that decided to quash the case in Roe v. Wade, the landmark 1973 decision that established the legal right to abortion in that country.

In a document sent to the Court, the Colombian Ministry of Justice assures that in the case of the sentence “we are faced with the specific case of the formal and material constitutional res judicata”, which means that it believes that in the previous sentence of 2006 The same court had already taken a binding and final decision and it should not go into the same issue again in depth as it did.

In that 2006 decision, the court allowed abortion in three exceptions: when the woman’s physical or mental health is at risk; due to fetal malformations incompatible with life; And when he is the victim of sexual access, non-consensual artificial insemination or incest. However, in February 2022, it studied a new trial and took an important step by decriminalizing abortion up to the 24th week of pregnancy and retaining three exceptions that apply to the rest of the pregnancy.

In a country with a conservative tradition like Colombia, the decision has generated protests, prompting requests not only to repeal the sentence, but also by some politicians and activists proposing a referendum to ban abortion, Which is still in the collection stage. civil firm.

According to Colombian Catalina Martínez Corral, director of the Center for Reproductive Rights in Latin America and the Caribbean, the recent ruling will be adequately protected legally.

“You can count on one hand the time when the court has quashed one of its sentences and when it has been done it is because of very serious procedural lapses, which did not happen in this case. The court did its job well, listened to all sides and responded to all requests for separation,” Martínez Corral told the Associated Press from Bogota.

The position in the government against decriminalizing abortion is not new. Upon learning of the court’s decision, Conservative President Ivan Duque, who defines himself as “pro-life”, expressed concern about the scope of the decision as he believed it would “Will facilitate abortion to become an almost contraceptive practice, recurrent and routine”.
