Facua accuses Warner Park of preventing access with food and drinks from abroad

And the same thing happens with amusement parks. Facua has just denounced the management company of Madrid’s Parque Warner for refusing visitors access to food and drink for “safety and hygiene reasons”. The organization believes that this reasoning is not consistent considering that it is possible to buy food inside the enclosure. As with various festivals, Facua has insisted that the main activity of these spaces is not gastronomy, but rather the practice of leisure activities and games, as well as the use of attractions.

Complaint

“This ban on entry to the venue is not necessary for the proper conduct of the commercialized activity,” said a statement released on Friday. And they recall that Article 82 of Royal Decree-Law 1/2007 of November 16 states that “any provision not individually negotiated and any practice not expressly consented to, contrary to the requirements of good faith, shall result in detriment.” of the consumer and user, a significant imbalance in the rights and obligations of the parties.

Section 8 of the above standard states that “the fundamental rights of consumers and users are the protection of their legitimate economic and social interests, in particular against unfair commercial practices and the inclusion of unfair terms in contracts”.

The consumer organization also refers to the report on the same subject published by the Spanish Agency for Food Safety and Nutrition (AESAN) in 2016, at the time due to the cinema ban.

It concluded that it was an “unfair term” because the consumer was “unjustly deprived of the main benefit by paying for the ticket”. Distribution of food and drinks.

Facua also invokes article 37 of Law 17/1997, of July 4, on public events and leisure activities. It states that “the arbitrary or improper exercise of the right of access” constitutes a very serious violation of public entertainment and leisure activities.

The organization is asking the Madrid City Council to open disciplinary proceedings against the company Madrid Theme Park Management SLU for refusing access to Parque Warner and Parque Warner Beach in Madrid with food and drink from abroad, of which it is aware that this action violates the applicable regulations in this matter. of consumption.
