FBI officer sacked during Trump’s tenure got pension back

With the resolution of the trial, the Justice Department and the FBI avoid the risk that moving toward trial could generate embarrassing information through the search process and statements. In September 2020, a federal judge dismissed the department’s efforts to dismiss the case, allowing the trial to proceed.

McCabe’s lawyers had planned to question FBI Director Christopher A. Ray and his former deputy David L. Boditch. Lawyers will also question Mr Sessions and his deputy Rod J Rosenstein at the time, as well as the Department’s Inspector General Michael E. Horowitz, among others.

Mr McCabe and his lawyers had argued that he was fired because he refused to take an oath of allegiance to the president at the time. He was also part of the FBI leadership that launched an investigation into whether any Trump campaign aides conspired with Russia in the 2016 presidential election. Mr Trump has repeatedly called the investigation a witch hunt and fired FBI Director James Comey at the time after expressing anger about the investigation.

Mr Trump had urged the Justice Department to get rid of Mr McCabe. After the media reported in December 2017 that Mr. McCabe planned to retire, Mr. Trump said on Twitter that “FBI Deputy Director Andrew McCabe is running to retire with full benefits. Let’s go. 90 days for?!!!”
