Flynn sues to block Jan 6 panel from obtaining phone records

WASHINGTON – Michael Flynn, a longtime adviser to former President Donald Trump, on Tuesday sued the congressional committee probing the deadly January 6 attack on the US Capitol for blocking him from accessing his phone records.

Flynn alleged, in a lawsuit filed in federal court in Florida, that a subpoena issued to him by the House of Representatives on January 6 was too broad and punished him for constitutionally protected speech as a private citizen.

The committee issued a subpoena in November to Flynn, Trump’s former national security adviser, testifying about a “command center” at the Willard Hotel in Washington to drive efforts to deny Democrat Joe Biden’s November 2020 election victory. More documents were requested. Trump falsely claimed that he lost the election because of widespread electoral fraud.

A spokesman for the January 6 select committee did not immediately respond to a request for comment.

Flynn’s trial is the latest in a flood of litigation by the committee’s goals to prevent the enforcement of its subpoenas for testimony or communications.

Conspiracy theorist and founder of right-wing website Infowars Alex Jones filed a similar case on Monday.

Flynn was charged as part of the investigation of former US special counsel Robert Mueller into Russian influence won by Trump in the 2016 US presidential election.

Flynn, a retired Army general, pleaded guilty to lying to the FBI in January 2017 about a conversation he had with Russia’s ambassador to the United States. Flynn later sought to withdraw the plea, arguing that prosecutors cheated him in a plea agreement. Trump later forgave him.
