A paradox of Fuerza Popular is that this group that imposed their conditions to approve the organic law of the National Board of Justice (JNJ) is now one of the political groups promoting the hunt against the magistrates of that institution.
On February 1, 2019, Keiko Fujimori’s party played a major role in Congress giving the green light to this reform. That day the Plenary approved the JNJ organic law with 80 votes in favor, including 42 from Fujimorism.
The opinion that received the approval of the Chamber considered nine bills. Of these, three former legislators Popular Force: Alejandra Aramayo, Rolando Reátegui and Edwin Vergara.
The then presidents of the Justice Commission, Alberto Oliva, and the Constitution Commission, Rosa Bartra, gathered all these initiatives to present an alternative text.
Their proposal stipulates that JNJ judges can be removed for serious reasons.
Danger alerted
Former congressman Pedro Olaechea questioned that provision. “We opened the door to arbitrariness, which tomorrow, I repeat, may have the majority of the opposite sign and completely reject the members of the JNJ for subjective reasons,” he warned.
“We set criteria that will blow us away and they will look for us,” Olaechea added, foreshadowing what would happen four years later in JNJ.
The fujimorist Luis Galarreta celebrating the Olaechea exhibition. “This seems to be one of the most reasonable and clear interventions in this debate, because there are many subjectivities,” he said.
Now the party advised by Galarreta seeks to remove the members of the JNJ for alleged serious misconduct: which decided the case of Zoraida Ávalos, who did not present an annual management report before the Plenary and allowed Judge Inés Tello, who is over 75 years old, will stay. in the office.
Disturbed opinion
Keiko Fujimori’s bank imposed its changes to support JNJ’s organic law proposal.
Galarreta questioned that, in principle, some of his colleagues proposed to remove the secrecy of the communication of the candidates. “Do we want to put together a reform of JNJ or do we want to put together a reform for some special friends, so that the least of the country can be used?” he protested.
Another controversial point is that the ruling does not ban those under investigation Office of the Prosecutor may compete for the position of magistrate. “When we talk about the principle of the presumption of innocence, the citizen is protected from abuse,” said former lawmaker Salvador Heresi.
Gender parity was also discussed in the establishment of JNJ, but it was also not approved. They choose an ethic based on meritocracy and equality.
The judgment was approved with the demands of Fujimorism and its allies: they only prohibited those convicted from applying and abolished the power to remove the secrecy of banking, taxes and communications of the applicants.
With that law, the foundations were laid for the creation of Special Commission who presided over the public competition for new JNJ judges. The congressmen who attacked the members of the Board today are not included in this part of the story.
Competition
Special Commission. The Executive and Office of the Ombudsman proposed that the advocate be the head of the Special Commission that manages the public competition for new members of the JNJ.
Support. In 2016 Fuerza Popular supported the election of Walter Gutiérrez as Ombudsman. Gutiérrez is leading the first public competition for current JNJ judges.
Minutes deny the selected memory
It is thanks to the votes and approval of Fuerza Popular in the opinion that there is a consensus in 2019 to approve the organic law of JNJ.
