His name is APA, and this Monday he sat on the bench in Section 17 of the Provincial Court of Madrid. He was driving drunk. It tripled the alcohol level and took the lives of Marta, 40 years old, and one of her two daughters, who was only 12 years old. The parties agreed to a prison sentence of four years and six months.
It was 9:30 pm on December 1, 2022. Marta, with her daughters, aged 12 and 9, got into the car. Belts were fastened, all calm. The woman looked in the rearview mirror and drove off. His car was parked in a battery on a street in Móstoles. He starts to join, but nothing comes. In seconds his life was gone.
A flash and quick movement. A big impact. Marta died immediately. Her 12-year-old daughter too. Inside the car, acting out of control, The only survivor was the youngest of nine years.. There was nothing he could do for his mother and sister when the ambulances arrived. Time of death: 9:40 pm The cause: a “frontolateral” impact with another car while Marta was maneuvering, left the parking lot, and entered the street. The vehicle that was hit was traveling at over 130 km/hour on an urban road. Your driver is drunk. After testing, he tested positive for drugs and tripled the rate of alcohol.
This Monday he sat in front of the judge, in front of Marta’s family. Alcohol and drugs
After the impact, the APA remained on the scene. It won’t take long for the emergency services to arrive. Marta and her eldest daughter lay lifeless. The girl was shocked. Municipal Police officers approached him. At first glance, this includes the police report, as considered proven in this trial, “there are external symptoms consistent with the consumption of alcoholic beverages”. APA, according to the prosecution and described by the agents, has a strong alcoholic halitosis. His movements are slow, he does not maintain verticality, and “his speech is pasty and repeated.”
The report provides additional data. “They also observe symptoms under the influence of drugs or narcotic substances.” They speak of “very red face and nose, appearance of nystagmus, hesitant and poorly spoken speech, repeating phrases or ideas, without stopping to speak.” They admit that APA “does not know what the time is, he has oscillations in the verticality of his body, he loses his balance, he moves with uncoordinated movements or poor coordination of his eyes and hands.”
The driver’s breathalyzer test showed chilling numbers: 0.96 mg per liter of air aspirated, which decreased to 0.94 in the second measurement made. APA was placed at the disposal of the police. He entered the temporary prison a day later. So far nothing has come out.
Alcohol, drugs and high speed. Police investigations show the impact speed to be between ,131.4 km/h and 144 km/h, higher than the generic speed limit, of 50 km/h, in urban areas. He was driving “non-stop” along the Avenida de Extremadura in Móstoles at the wheel of a car he owned after consuming alcoholic beverages and toxic drugs. And he did it “at a speed higher than that allowed on city roads and committing traffic violations.” Before entering the road where the impact occurred, he was seen at a roundabout. “He did not exit through the regulatory exit, but turned directly to the left in the opposite direction of traffic, with a serious risk of colliding with several cars traveling in the right direction.”
Four years and six months in prison and the withdrawal of his driver’s license. In terms of civil liability, the compensation for the death of the mother and child is set at 455,685 euros.
