After the inspection carried out by the Attorney General’s Office of the facilities at Fecode, within the investigation for the alleged irregular financing of the campaign of President Gustavo Petro, the defense of the president asked the National Electoral Council to report whether he participated in the procedure.
In the dialogue with La W, Julio César Ortiz, the president’s lawyer, explained that the objective of the request is to clarify if the electoral authority ordered the search because, if not, he considers the evidence invalid.
“We intend to determine the legality of the evidence, that of the quotes, raid because we believe that, according to the Constitution and the Law, in these matters of donations and contributions, unless there is a principle of the prohibited source of resources such as drug trafficking, “the only one competent to determine the conformity with the law of these donations is the National Electoral Council,” he stated.
In the same way, the jury showed that, if the CNE was not involved, the Prosecutor’s Office would be prevaricating.
“If the Prosecutor’s Office seeks to determine whether the donation (from Fecode) is legal or illegal, it is a violation. If it is not ordered, requested, or requested by the National Electoral Council, that test is completely illegal.” if we find out and we ask the CNE to tell us if he gave the order because, if he gave the order, he should inform us of the lawyers, so that we can dispute the evidence and attend the proceedings,” he said.
Finally, Ortiz revealed that he also asked the electoral authority to summon the current superintendent of public services, Dagoberto Quiroga, “who should have received the money from Fecode and became president at the time of Colombia Humana,” as well as the appearance of the manager or president of the company hired by the party to accredit witnesses for election day.
