Provisional suspension against extinction of PJF trusts granted

A federal judge has granted a temporary suspension to María del Carmen Cordero Martínez, judge of the First Collegiate Court in Civil and Labor Matters of Chihuahua, temporarily halting the reform in which the 13 trusts of the Judicial Branch of the Federation were eliminated.

The federal government can challenge the ruling to have the case referred to a collegiate court that will decide whether to confirm, modify or revoke the resolution in the first instance.

Juan Fernando Luévano Ovalle, Judge of the Twelfth District of Chihuahua, temporarily prohibited the CJF from transferring resources to the Ministry of Finance and Public Credit (SHCP) and the Treasury of the Federation (Tesofe).

The precautionary measure is for the Executive Secretariat of Administration of the CJF, Secretariat of Finance and Public Credit (SHCP) and Treasury of the Federation (Tesofe) “or that, according to their respective competence, there is intervention in the administration, operation. and dispose of the resources of the trusts specified above, must do the following: Avoid using the consequences and effects of the claimed provision contained in the decree to which the second paragraph of article 224 of the Organic Law of the PJF is added, ” says the judge’s agreement.

But not only that, they also “avoid canceling or extinguishing the trusts and guarantee their continuity, operation and management of the matter in which the trusts held by CJF are created, in compliance with the rules of operation of each of them.” Immediately suspend the delivery and/or transfer of the resources of all the trusts held by the CJF, as well as their remains, products and uses obtained from them, to any authority entrusted to the federal executive or the trust entities themselves, except for the powers. for the administration and disposal of the resources of each of them for their operation.”

The complainant highlighted the demand for guarantees on October 30, four days after President Andrés Manuel López Obrador proclaimed in the Official Gazette of the Federation (DOF) the reform in which the 13 trusts of the Judicial Branch accumulated more than 15 billion pesos.

In his lawsuit, the judge granted the order that eliminated 13 of PJF’s 14 trusts. On his part, the judge set for 10 am on November 29 to hold a constitutional hearing where he will determine whether to grant a definitive suspension against the acts complained of.
