Marin County Parents May Face Prosecution For Sending COVID-Infected Child To School

The Marin County District Attorney’s Office is considering charging fees for parents who send a child with a positive COVID diagnosis to school in Corte Madera.

County authorities referred the case to the prosecutor’s office due to possible violation of public health laws. Authorities say the parents deliberately sent their infected child and his brother or sister to school and did not notify the school administration about the infection.

An alleged violation of public health protocols resulted in the infection of eight children and a 10-day quarantine of 75 Neil Cummins elementary school students during a Thanksgiving hiatus.

“The case has been referred to law enforcement and the district attorney’s office for review and action for non-compliance with local isolation and quarantine procedures under California Health and Safety Code § 120295,” said Lane Hendrix, a county spokeswoman. … “We do not expect a final decision before the end of the holiday season.”

District Attorney Laurie Frugoli’s spokesman said the matter was pending Tuesday but declined to provide further details.

None of the children became seriously ill, but the incident required hours of checks and vacation travel plans to be canceled.

Dr. Matt Willis, the county health officer, said the parents refused to comply with an order to keep their infected child at home for 10 days and also refused to tell public health professionals which school the child was attending. Instead, they sent the child and his sibling to school for seven days and did not notify the school of the COVID-19 infection, Willis said.

They also did not respond to any follow-up calls from district health personnel, Willis said, forcing the district to spend days tracking the school and extending the exposure to the virus.

Willis said the actions violated both the Marin County Student and Family Guide to COVID-19 Safety and the Marin County Isolation and Quarantine Act. The order and guide require a 10-day home quarantine for cases of COVID-19 infection.

Violations can lead to fines or criminal prosecution as misdemeanors, Willis said.

According to Brett Gaitman, superintendent of the Larkspur-Corte Madera School District, the parents, whose names were not disclosed by the authorities, took “corrective actions” by the district, which included “reporting to required authorities such as public health and law enforcement.” …

“We provided them with all the information they needed on this case,” Gaitman said on Tuesday. “The next steps are in the hands of the district attorney.”

Gaitman said the parents also sent a letter of apology to Director Gaitman and Neil Cummins Kyle Shaw. They did not offer an explanation for their actions, other than to say that they did not initially understand the COVID-19 protocols, Gaitman said.

Issues such as language barriers or economic difficulties were not factors in this case, Gaitman said.

According to a copy of the letter, in which the parents’ names were edited, the parents apologized “for the disruption of the school and all the inconvenience caused by our actions.”

“This was the result of very bad judgment on our part and will never happen again,” the letter says. “We want to assure you that we did not want to create this kind of problem and clearly misjudged the circumstances.”

The parents also suggested talking to the child’s teachers, but “we are also not sure if it is appropriate to talk to our teachers now or is it better to postpone it for later. I would appreciate your guidance on this. ”

This incident is the second time that the outbreak of COVID-19 at Marin School has received global attention. Earlier this year, the Centers for Disease Control and Prevention released the District’s 2020 Outbreak Response Report at Our Lady of Loretto School in Novato.
