The doctor who assessed Francisco Javier Almeida, accused of the kidnapping and gradual killing of Àlex in Lardero, stated in his trial on Thursday, March 23, that no psychocognitive change was detected in the defendant. Check that he remembers well what happened, that he speaks well and that he understands and understands.
This psychopathological examination was carried out when the alleged murderer was transferred to Segovia prison from Logroño prison. Thus, the doctor indicated that he did not suffer from any mental illness and that he knew that what he was doing was illegal.
Professionally confirmed at the time of the psychiatric, at the beginning of November 2021, Almeida “knows the illegal act and desires, his will and conviction”, in the data collected by Caso Abierto.
This doctor testified by videoconference on the fourth day of the trial with the People’s Tribunal, which is held in the Provincial Court of Logroño against Almeida, for the events that took place on October 28, 2021.
The doctor indicated that after a psychiatric examination was carried out on Almeida at the Institute of Legal Medicine in Segovia, no “elements of scientific evidence were found to assert that his volitional and cognitive abilities were altered due to alcohol intoxication or mental disorder.” .
In this examination, he continued, his faculties assessed memory and they did not find “any alteration of the mind which implies a lack of memory, it is another thing that he says,” but it is verified that he had no alteration in himself. attention and awareness. And the defendant, in the first session of the trial, professed that he did not remember what had happened, that it was in his head as if covered.
He also said that the evaluation found that he “does not have any mental disorders, apart from the waking hours, which he says he suffers from in prison”, because he claims to sleep badly, which he fears that his colleagues will do. something for him while he is in prison.
On October 29, 2021, one day after the incident, the defendant requested to be evaluated by a doctor, since he thought he had some mental illness that would lead him to act like this. the psychiatrist who later examined him also reviewed the medical report he received at that time.
Almeida reported that “his side was injured because he had been kicked”, but this report details “there are no physical injuries”, it does not refer to any mental alteration and the doctor who helps him does not mention any external signs of alcohol poisoning. on the other hand, the psychiatrist who testified gave an appearance in court.
Almeida also said in his statement that he had been drinking beer all morning. This was denied not only by the medical report, but also by those who supported the law, since they did not see in him a drunken man nor smell of alcohol.
In addition, in this initial report it was already mentioned that he required medication for blood pressure. “He remembers that he suffers from a chronic illness and is fully aware of his own personality, he wants to be well,” the psychiatrist verified here, because of which he “concluded mental decompensation or loss of contact with reality.”
Several doctors from the National Institute of Toxicology also testified, via videoconference from Las Rozas (Madrid), who were in charge of analyzing the biological remains and fluids in the child’s corpse and in the samples sent after his autopsy.
These confirmed that the death was suffocated from the presence of several hemorrhages in the lungs; and he showed that great force had been used to injure the larynx, which was shown by the bruises which the boy had found in his mouth when the agents had done so.
The prosecutor, the private prosecution of the boy’s family and the public prosecution, on behalf of the Clara Campoamor Association, are asking for a permanent prison sentence for the defendant for the crime of murder and 15 years in prison for the crime of sexual assault. His defense continues to petition for acquittal.
