Now more Latinos will be able to apply for Spanish nationality, these are the requirements

The law extends what was set out in 2007 by Spain.

The Democratic Memory Law facilitates access to Spanish nationality for thousands of Spanish descendants who were born overseas. This regulation expands on a law adopted in Spain in 2007, which set the possibility of acquiring nationality for those who had a Spanish father or mother of origin. This was applicable to their children, if they were minors. This regulation is no longer in force.

The law was created with the aim of repairing the victims of the Spanish Civil War and the government of Francisco Franco. However, as referenced by the BBC, the law benefits a large number of Latin American people, thanks to an additional eighth that makes it easier for three specific groups to obtain Spanish passports:

1) People born outside Spain. Their father or mother, grandfather or grandmother, must be Spanish in origin and have lost or relinquished their Spanish nationality, due to deportation for political, ideological, sexual identity, belief or dissatisfied orientation reasons.

2) The sons and daughters of Spanish women who were born abroad, and whose mothers had lost their nationality to marry foreigners, prior to the 1978 constitution.

3) sons and daughters who are of the legal age of Spaniards, whose nationality of origin was recognized on the basis of the right of choice in accordance with the provisions of this Law or on the basis of the seventh additional provision of Law 52/2007 of 26 December 2007.

The process should be completed and formalized within two years of the enactment of this law.

What has changed with this law?

In the past, the grandchildren of Spaniards whose parents had acquired nationality had age restrictions for obtaining citizenship.

1) be born before January 1985 and your parents (born outside Spain) acquired nationality before the birth of the interested party.

2) Being under 21 years of age and their parents (born outside Spain) obtained nationality before the birth of the interested party.

3) Being under 20 years of age and their parents (born outside Spain) acquired nationality after the birth of the interested party and before the age of 18.

The current law does not establish any starting time, unlike the 2007 law, which assigned an additional term for processing Spanish nationality, at which point its official dependency was drawn up to receive new applications.
