The representative reacted in this way to the determination of the magistrates of the highest judicial forum of the Caribbean island under the allegation that an appeal was not notified to the Office of Court Administration (OAT) within the established period.
Due to this situation, the ruling issued by Judge Anthony Cuevas, of the Court of First Instance, on November 17, 2023 on the retroactive increase in the salary of members of the judiciary, was implemented.
“All the parties must be informed within the term established by our law and we confirm it right before the court,” said Hernández Montañez.
The representative of the opposition Popular Democratic Party (PPD) said that “the immediate effect of this decision-without the signature of its speakers-is that the Judiciary-especially the judges themselves issued this decision -legislating for their own privileges and benefits” .
This happened, he affirmed, “to the detriment of the Constitution of the Commonwealth of Puerto Rico that they swore to protect, in a historic moment where the credibility of public institutions is at risk.”
Hernández Montañez warned that the Judicial Branch itself is not exempt from these questions because of the major deficiencies in its operation that cause frequent re-victimization of those affected by crime in the face of the wave of femicides that cover the country.
He attributed to the judges “the unjustified loss of lives (of women) due to the incompetence of that system that now pays itself with bonuses and privileges.”
He explained that this Friday he received a notification from the Supreme Court of Puerto Rico that its members rejected the appeal presented by the House of Representatives to defend the constitutional rights and the doctrine of separation of powers for—allegedly —the appeal was not perfected within the term. jurisdiction.
By differentiating this approach, the leader of the Puerto Rican representatives called “for prudence”, while establishing that “our lawyers are preparing an appeal for reconsideration, based on the law – so that the highest judicial forum can adjudicate this controversy on its merits.”
He stated that the House of Representatives “will not surrender the defense of constitutional rights in the face of the excessive use of a frivolous technicality to obtain a personal benefit to the detriment of the Legislative Branch.”
Hernández Montañez expressed confidence that “the Supreme Court will abandon this harmful precedent.”
