The Tax Administration Service (SAT) will receive at least 107.8 million pesos in payment of fines from large taxpayers that resulted in not giving their tax opinions in time for the 2022 fiscal year.
According to the Mexican Institute of Public Accountants (IMCP), between 7,000 and 7,200 large companies did not submit their opinions on time because of irregularities in the tax authority system.
It should be remembered that the minimum fine for companies that do not rule on financial statements is 15,410 pesos. While the highest violation costs 154,050 pesos, and even a temporary suspension of the Digital Seal Certificate, according to the Fiscal Code of the Federation.
Jesús Rodríguez Umbridge, a member of the Honor and Justice Commission of the Mexican Association of Public Accountants (AMCP), told this space that the SAT penalty is automatic.
“Even if the taxpayer submits the tax report, it will be additional provisional and invalid, as it was not submitted on time, which is why the authority automatically issues the penalty. In addition, the SAT will audit the company”, Rodriguez Umbridge said.
The deadline for filing tax returns for the year 2022 ended on Monday, May 15. For this year, the submission of documents was mandatory and the time given was reduced, which was July 15 before the deadline.
The interviewer said, “Companies can defend themselves through a taxpayer defense attorney (Prodecon) or a private lawyer as to why they did not submit the tax report.”
Prodeacon provides free representation and protection to taxpayers who have a tax debt or tax payment of up to 37,844 pesos for this 2023.
“It is a large percentage of taxpayers who, under certain circumstances, could not furnish tax opinion. Through Prodeacon, management can be done so that SAT can open the doors and get some agreement or administrative convenience,” said Ambareez .
