Senate rejects second Democrat attempt to include amnesty for illegals in parliamentary reunion

Since the beginning of September, Senate Democrats have been trying to persuade the Senate’s non-partisan referee, the parliamentarian, to include a general amnesty for illegal aliens in their reconciliation bill. The MP fired the first attempt in mid-September; On Wednesday, Democrats were again disappointed after lawmakers denied their second push.

Incumbent Elizabeth McDonough’s blessing will be needed because Democrats are using their r. 5 trillion budget in hopes of passing a bill that has not received Republican support.

In particular, they are using the reconciliation process, a parliamentary system was added to the Senate rules in the early 1970s. This process allows certain types of budget bills to pass through deliberately high chambers with a simple majority, completely bypassing the opposition’s filibuster. Ultimately, what is approved under this process depends on McDonough, whose job it is to protect the rights of both parties.

A. Press conference Before the lawmaker made his first ruling, Sen. Dick Durbin (D-Ill.) Indicated that Democrats “believe that immigration is an important element of reconciliation.”

“For how many years have we all complained that America’s immigration system is broken and needs to be fixed?” He asked, adding that the latest comprehensive immigration reform from Congress was passed 35 years ago, signed by President Ronald Reagan.

Under the permanent rules of the reconciliation process, the provisions of the reconciliation bill must have an impact on federal government spending and revenue that is more than “merely incidental.” Darwin argued that immigration reform “has a cost associated with it” and that it was applicable under the Reunification Rules.

Democrats will go to ‘Plan C’: Menendez

At the first attempt of the Democrats, about one million illegal aliens in the country could already be eligible for amnesty. This second attempt was less high, and only illegal immigrants tried to change the date of eligibility on the path to citizenship.

This attempt was again denied, in keeping with McDonough’s track record. While in this position, McDonough was not ashamed to kill the priorities of both parties whom he considered out of reach.

In 2017, for example, Republicans sought to add a provision to the Tax Cuts and Jobs Act passed through the reconciliation process – which repeals bans on churches, charities and universities that prohibit such nonprofits from becoming politically involved or supporting candidates. . .

After the Democrats regained a majority, McDonough also imposed restrictions on what they were allowed to do. In February, lawmakers ruled against including a মজ 15 minimum wage in a CCP (Chinese Communist Party) virus relief package proposed by President Joe Biden.

In both cases, the majority party tried to convince McDonough that the provisions were related to a small budget-related benefit.

Sen. Bob Menendez (DN.J.), a proponent of using reunification to change immigration laws, called McDonough’s decision “unfortunate.” He explained, “I do not agree with the basic principle from which I am working,” referring to his irrational attitude towards reconciliation.

Nevertheless, Menendez hinted that despite the failure of their first two attempts, the Democrats would still push for a third and move on to “Plan C”. The senator was discussing the details, telling a reporter, “It’s up to me and you to find out.”

Democrats reaffirm White House commitment to immigration reform

Menendez, however, said that “if there is no way for us to adjust the status quo for the undocumented,” he would not support provisions designed to help businesses. “We will not take care of the business and take care of the 11 million people,” Menendez said.

But without parliamentary approval, Mendenz and his colleagues will have no choice, due to McDonough’s unilateral control, which is not acceptable for reconciliation.

A major immigration center for Congress and the President’s Democrats was the status of so-called “dreamers.” The group is made up of people who entered the United States illegally as children and received a general amnesty under the Deferred Action for Childhood Arrivals (DACA) for a controversial executive order signed by President Barack Obama. Under the Democrats’ initial proposal to McDonough, millions of dreamers would have found their way to citizenship.

The Biden administration has indicated that this is still a key focus.

Homeland Security Secretary Alejandro Mayorcas, who runs the department responsible for dealing with illegal immigration, said after the ruling: “The Biden-Harris administration is taking steps to protect dreamers and recognize their contribution to this country … We support the inclusion of immigration reform in the bill and call on Congress to act quickly to give dreamers the legal status they need and deserve.

“We are committed to immigration reform,” said White House Press Secretary Jane Sackio. “I hope it will renew a look for what vehicles and options might be,” he added.

Because reconciliation is the only way to legislate through the Senate with a simple majority, the only chance for Democrats to advance their immigration agenda without their Republican support. If any other law is executed by Philibaster, it can only be ended by a vote of 60 senators.

The bill is currently set for a House vote on Thursday. With this push, Democrats have time on their hands if they can create a new schedule if they expect to maintain that deadline.
