Supreme Court on Nupur Sharma: Suspended BJP leader Nupur Sharma has got a big relief from the Supreme Court. The Supreme Court has issued a notice on the demand to transfer the FIRs registered in 8 states to Delhi in the controversial remarks case on Prophet Mohammad. The court has said that the next hearing of the case will be on August 10. It has also been said in the order that Nupur Sharma should not be arrested at present in any FIR registered in the case of the TV program that took place on 26 May.
Earlier on July 1, the Supreme Court had refused to hear the matter. Then the bench of Justice Suryakant and Justice Jamshed B Pardiwala had strongly reprimanded Nupur Sharma. He was blamed for the deteriorating situation in the country. The judges asked Nupur Sharma to come on TV and publicly apologize to the whole country. At the same time, it was also said that the Supreme Court will not hear the matter. Nupur should go to different High Courts and apply for cancellation of the FIR lodged.
Nupur Sharma’s arrest stayed
In the new petition filed by Nupur Sharma, it was said that there was already danger on her. The danger has increased after the Supreme Court’s comments. In view of this, he had demanded that the Supreme Court should stay his arrest and transfer all the cases to Delhi. Today this matter once again came before the bench of Justice Surya Kant and Justice Jamshed Pardiwala, but today the attitude of the judges had changed.
Nupur Sharma’s lawyer’s argument
Arguing for Nupur Sharma, senior advocate Maninder Singh said that the situation has changed since the court’s observations on July 1. There is a possibility of a person from Pakistan coming to India with the intention of killing Nupur. Some people have been arrested in Patna. He was also plotting to kill Nupur. In such a situation, it will not be possible that Nupur should apply to different High Courts of the country. This can put their lives in serious danger.
What did the Supreme Court judge say?
The judges took the matter seriously. Justice Surya Kant, chairman of the bench, said, “When we asked you to take alternative legal avenues, our motive was that the power to quash the FIR is with the High Court, you go there, but now it is possible to do so in the changed circumstances.” It is not felt. In such a situation, we will solve this problem. On this Maninder Singh said that earlier the FIR was registered in Delhi, so he is demanding to transfer all the cases to Delhi. After the matter is transferred to Delhi, he Can apply for cancellation of FIR in Delhi High Court.
Supreme Court issued notice to the states
The judges said that they want to amend their previous order, but for this it would be better to hear all the parties. Apart from the central government, the court also issued notices to the governments of Delhi, Telangana, Maharashtra, West Bengal, Jammu and Kashmir, Assam, Uttar Pradesh and Karnataka in the matter. The court said that the matter will be heard further on August 10. The judges made it clear that till then Nupur should not be arrested in any FIR registered regarding the TV program on May 26. If any other FIR is registered in this case in future, then Nupur should not be arrested in that also.
Petitioner’s life in danger: SC
During the hearing in the Supreme Court, the judges also referred to the video released by Khadim Salman Chishti of Ajmer Dargah, in which Nupur Sharma was threatened with throat slit. The judges also referred to a similar video released by a person from UP. The judges said that there is a serious threat to the life of the petitioner. In such a situation, the intervention of the Supreme Court is necessary in this matter.
