The young woman who accused Dani Alves of sexual assault confirmed this Monday before the court that the footballer raped her in the bathroom of the Sutton nightclub in Barcelona and her fear that she would not be believed if she reported, a version supported by his two friends.
In the 21st section of the Court of Barcelona, the trial began this Monday against a Brazilian player, accused of raping a 23-year-old girl in the small bathroom of a booth in the Sutton nightclub in Barcelona where he invited her to dance with the two. his friends in December 2022, a case in which the Prosecutor’s Office requested nine years in prison and 12 for private prosecution, brought by the victim.
“parallel trial,” to which he was subjected, and because the police investigated him “behind his back” for weeks.
Allegations rejected by the court after ordering any “anomaly” of the accused in the right of defense, although it agreed to the request of his lawyer, Inés Guardiola, that the footballer testify at the end of the trial, once a witness and expert, and know all the evidence against him.
The victim, the first to testify
In this way, the first to testify in the trial, which is scheduled to last until this Wednesday, is the victim, in an interrogation that lasted more than an hour, alone behind closed doors and between intense steps to protect his identity and avoid. his visual confrontation with Alves.
In his statement, the legal sources explained, he continued before the Court of Barcelona the story he continued throughout the investigation of the case: that Alves sexually assaulted him, with violence and a contemptuous attitude, after she was urged to enter the hospital with him. cramped booth bathroom at Sutton Nightclub.
He also repeated, as he had already done in the investigation, his initial reluctance to file a complaint against the player, convinced that no one would “believe” him.
A cousin and a friend corroborated the victim’s version
The version of the victim, who according to sources kept his composure during the interrogation although sometimes could not stop crying, was confirmed by two young women who accompanied him in Sutton on the night of December 30, 2022, who also testified between tears.
The witnesses, a friend and a cousin of the victim, detailed that, since the presentations, Alves touched them in a “slobbery” manner until they felt “uncomfortable,” although they did not. It is thought that this may cause rape.
According to two witnesses, the three women agreed to enter the booth where Alves was with a friend after he invited them, through a waiter, to drink with them in the VIP area of the nightclub. small private bathroom.
The two indicated that they saw the player enter the door leading to the bathroom—they did not know that it was a toilet—that his friend did it a few moments ago and that after a quarter of an hour, Alves and, two minutes later, the victim, who had a “bad face,” urged his colleagues to go home.
According to her friends, the young woman cried “heartbroken” and said that the soccer player had done her “a lot of damage,” but at first she was reluctant to report him while repeating, “I want to go home; they don’t believe me.”
The days after the events, they added, the young woman remains in shock, still does not want to report, and currently, she continues to suffer from anxiety; she is about to leave the house; she feels guarded and has lost the “joy” described to him because he became obsessive about “everything.”
The lawyer of Alves directed his interrogation to undermine the testimony of the two friends, to whom he asked if the accused and the young woman danced “close together” before entering the bathroom, if they smiled at each other, and if their attitude was flirting. Some questions were raised without any kind of prohibition in court, and the witnesses answered with evasions.
