The Council of Government approved a new order to regulate housing for tourist use

The Council of Government approved the decree, which changed various provisions about housing for tourist use (VUT), tourist apartments, and hotel establishments in the community of Andalusia. These changes, agreed upon by the agents of the sector, aim to adopt concrete measures to respond to a new trend in tourist accommodation.

Among the main innovations in terms of housing for tourist uses, it is established that the town councils, for compelling reasons of general interest, can build limits corresponding to that factor about the maximum number of houses for tourist use per building, sector, area, period, area, or zone.

With this change, on the other hand, come new requirements regarding those provided by Decree 28/216, of February 2, for the use of an economic activity, such as the provision of tourist housing accommodation services, according to European and national regulations that regulate the principles of free access to the market.

Also, by what is established in the Law on Tourism, the legal number of companies that operate housing for tourist use is strengthened to professionalize the activity, which in turn seeks to improve the working conditions of the workers, facilitate relations with the administration of tourism, and guarantee the rights and duties of users.

Other of the changes included in the housing requirements need conditioning or common services for greater quality of service provision and protection of users’ rights, such as the maximum surface area per person, the number of bathrooms or air conditioning, etc.

About tourist apartments, the different specialties are regulated, emphasizing that no establishment can discriminate or restrict unwanted groups and extending the period of occupation of accommodation units, which is from 3:00 in the afternoon of the first day of the contracted period to 11:00 am on the day of the scheduled departure date. At the same time, the characteristics of different groups of tourist apartment establishments are defined and established. In the same way, part of the requirements for the provision of tourist accommodation services were eliminated following the recent regulation of hotel establishments, which eliminated the requirement of structural obligations if the counterparts of the regulation of the sector have made them suitable for the intended end.

Finally, the decree includes changes so that hotels and hotel apartments can offer complementary services to users of the establishment, even if they are given to people or entities other than the owner of the tourist accommodation operation, as long as they meet certain requirements without affecting the principle of the operation unit.
