The fifth section of the Provincial Court of Pontevedra, based in Vigo, sentenced, according to the verdict of the Jury Court, Pablo Posada, a sexagenarian accused of stabbing his neighbor to death in October 2022 in a building on Zamora Street, in Vigo.
In the proved facts section of the sentence, the presiding judge of the Jury Court stated that both had “coexistence problems” because of the noises the defendant accused his neighbor of making.
On the day of the events, according to the resolution, they met by chance outside the property; Then the convicted man entered the door, immediately exited and, after the victim told him to “fuck off,” he entered again at 8:12 pm and went up to his apartment.
At 8:51 in the evening, the victim passed by his neighbor’s studio and, when he opened the door of his house, the accused ““He approached her from behind with the intention of killing her, carrying a red knife.”
The Jury Court considered that the existence of treachery was proven, which served to classify the homicide as murder, because it emphasized that the attack with the knife “happened to the victim on his back, in a strange and sudden way”, so that the woman ” She can do nothing to defend herself.”
The first attack, according to the decision, was from the rear.
“Still knowing that they were going to end his life, he managed to enter the house, leaning on a small table in the side of the room next to the door. The intent to kill was proven, according to members of the Jury Courtbecause of the statements of the accused and the nature of the weapon used, the number of stab wounds and the parts of the body he was referring to.
Cruelty, as stated in the sentence, was the point most discussed by the jury, who concluded that, since the second wound was fatal, the fact that a certain amount of time had passed (without being able to determine whether how much) between it. One and the next, along with the different paths followed by the knife, will show “that these last stabs were not necessary to carry out the purpose intended by the accused to kill the victim, but they were also intended to increase his pain .”
The Court of Jury, therefore, understood that this circumstance should be appreciated. The sentence is not final, because an appeal can be filed against it before the Superior Court of Justice of Galicia.
