The Investigative Court No. 8 in A Coruña ended the instruction in Samuel’s case and opened an oral trial against five people for the crime of murder, appreciating the aggravating circumstances of treachery and cruelty. The judge considered that there was enough evidence to place the five as co-authors in the dock. In the case of both of them, the man and woman whom the victim first encountered, he considered that there were also aggravating circumstances of discrimination based on sexual status.
Another one of those investigated will be tried, in addition to the crime of murder, for robbery with violence. In the case that will be judged by a celebrity jury, in addition to the prosecutor’s office and the defense, there is a private accusation and a popular one.
The trial is scheduled to be held in the Provincial Court of A Coruña before the summer. For now, the personal situation of the accused will not change: three of them will remain in prison and two will remain free.
The judge in his order recounted how two of the defendants were initially charged “with intent to cause death” of the victim, and in any case, “knowing” that their actions could cause fatal consequences or “accepting the risk that it involves,” they kicked and punched in the face and head, while the woman accused of the procedure, “in unison in the action of the attack,” tried to prevent the late deceased from helping a friend.
According to all the accusations, in a short time, two other people will also be charged, in addition to two minors At the time of the events, they were already convicted of felony murder.
According to the judge in his order, “in that scenario, the victim was surrounded and beaten, defenseless, at the mercy and will of his aggressor group, in a clear state of inferiority and helplessness, with no possibility of defense.
All the accusations demand 25 years in prison for the two defendants who are considered to have acted with the aggravating circumstance of discrimination because of the sexual status of the victim, and 22 for the other defendants. To this, we must add the 5 years demanded for those accused of violently robbing the deceased’s cell phone.
Although the arrests took place shortly after the events, the investigation of the case was complicated, among other aspects, because of the letters of rogatory that had to be sent to the United States to access the content of the accounts on social networks and similar suspicious applications.
