A professor who was suspended for refusing a push to give easy exams to black students has filed a lawsuit against his school for breach of contract and other violations.
Gordon Klein, a professor at the University of California-Los Angeles (UCLA), was asked last year by a group of black students to grade their black classmates more gently. They wanted him to give them a “no-ham” final exam that would “benefit students’ grades if taken”.
The group said black classmates should be treated unequally because they are “facing the consequences of state-sanctioned violence on social media and graphic content that moves into our own cities and our own communities in Westwood.” The email appears to be referring to George Floyd’s murder by police.
Klein rejected the request, sparking outcry from people who organized a campaign that accused him of being racist. This leads to UCLA’s Anderson School of Management, where he teaches, to discipline him. She was suspended, banned from campus, and hired to teach her classes to others.
According to a lawsuit filed in California Superior Court in Los Angeles County, the school’s dean, Antonio Bernardo Klein, was dissatisfied with the alumni and the general public.
The school wrote on social media, “We are deeply disturbed to know this email, which we are investigating.”
When the university blocked Klein from firing the school and he resumed teaching, he filed a lawsuit because he did not want to use another professor in the same way.
“They had a pattern of violating people’s academic freedom and engaging in a culture of neglect. It shouldn’t be with anyone, and I’m against it, “Klein told The Epoch Times.
In some cases, universities have “lost sight of the fact that their main goal is to educate students, ethnically profiling and segregating students or treating them differently on the basis of their group identity.”
The lawsuit alleges violations of the California Constitution and the California Labor Code, including the right to privacy, protection against retaliatory discrimination, and the duty of an employer to remain politically neutral. It also asks for damages.
“Due to privacy and privacy laws and concerns, we are unable to comment on this at this time,” a UCLA spokesman told the Epoch Times in an email. “However, we can share that the university has general procedures and policies that support freedom of expression and intellectual inquiry and facilitate an education, work and living environment free from discrimination, harassment or retaliation.
“To this end, all reports of alleged misconduct are carefully and impartially reviewed by the UCLA Office of Equity, Diversity and the Civil Rights Office of Inclusion. This office takes the report seriously when making sure there are no interruptions. To promote transparency, the UCLA Office of Equity publishes annual public reports, including aggregate information on complaints, diversity and inclusion complaints, and results.
