The initial hearing against the Rector of the Autonomous University of Sinaloa, Jesús Madueña Molina; former Rector Juan Eulogio Guerra Liera and eight UAS officials, was deferred this Wednesday because 12 defense lawyers resigned.
From the beginning of the hearing, the litigants informed the Judge that the State Attorney General’s Office provided seven new volumes and a complement to volume 20 just one day before; In addition, they gave FGE 1,300 canceled invoices.
Almost all of the lawyers asked for a two-month delay, except Lorenzo Flores, defense of Ismael García Castro, who asked for three months since he took the oath of office.
Prosecutors pointed out that the defendants collected new papers on October 5, 6, 9 and 10; They accused the accused of trying to delay the process and said that the hearing should not be postponed, because the seven new volumes are not available to the Prosecutor’s Office.
In the case of the newly appointed lawyer, they suggested to the Judge that he be separated from the rest of the process and set aside.
The defense responded that although the Prosecutor’s Office did not use it, the evidence in the new volumes would help the defense, so the delay was necessary to prevail on the entire file.
After a recess, Adán Alberto Salazar Gastélum decided that there are conditions to open the hearing, making sure that he will ensure that the Prosecutor’s Office will not take advantage of the new information. This caused the accused, defenders and the public of the university to laugh out of anger.
Afterwards, the litigants filed an appeal for revocation, telling the Judge that his decision violated the right to an adequate defense and warned that if the hearing was opened, they would all resign.
In addition to this, the legal representatives and legal advisors of the UAS joined the appeal of the revocation, under the argument that the University, as the offending party, should have access to the entire research folder, because it was also given they had it the other day. .
José Ramón Bonilla Rojas, legal adviser, took advantage of his intervention to complain that the UAS “is the public enemy of the State,” and emphasized that the Governor talked about the UAS in “La Semanera.”
The debate closed at 11:19 am and, before continuing, the defense lawyers explained the new strategy and wrote on sticky notes the speeches that their clients would give later.
Judge Adán Salazar continued with the conditions for opening the hearing and forming the accusation, before the Prosecutor’s Office spoke, the lawyers interrupted so that their clients announced their dismissals.
As the defendants withdrew their defenders, from a serious expression they turned into a lot of laughter, as they forced the postponement of the hearing.
Jesús Madueña Molina, Juan Eulogio Guerra Liera and the UAS Acquisitions Committee have three days to name their new lawyers, and will return before the Judge on November 10 at 9:00 am.
