The US proposes to modernize the program for Professionals with Special Occupations

The United States intends to modernize the H-1B program as soon as possible, which includes professionals with specialized occupations. The idea of the Department of Homeland Security (DHS) and the United States Citizenship and Immigration Services (USCIS) is to streamline eligibility requirements.

Both agencies have published a Notice of Proposed Rulemaking (NPRM) that will also improve the efficiency of the program. Among other advantages, the presented variant will provide greater benefits and flexibility to employers and workers. As if that wasn’t enough, it also strengthens the integrity measures.

What is the H-1B program and how does it work? Through this, American employers receive assistance in hiring the workers they need. Here, of course, the commercial requirements of each business are taken into account. Global market competitiveness is also respected, as well as all legal protections aimed at American workers.

National Security is involved in the changes

DHS has been involved in every step of the new proposal to modernize the aforementioned program. That is why the Secretary of National Security himself, Alejandro Mayorkas, addressed the issue. “DHS continues to develop and implement regulations that increase efficiency and improve processes for employers and workers as they navigate the immigration system.”

The senior executive also emphasized that “it is a priority of the Biden-Harris administration to attract global talent. It is also important to reduce undue burdens and prevent fraud and abuse in the immigration system.

The H-1B nonimmigrant visa program allows employers in the United States to temporarily hire professional foreign workers in specialized jobs. The law defines these professions as requiring highly specialized knowledge and a bachelor’s degree or higher degree in a specific specialty, or its equivalent.

The proposal is expected to change the way USCIS conducts the selection process to select individual beneficiaries instead of records. The new option will increase the probability that the registration is legitimate. Thus, the advantage of submitting multiple registrations for the same beneficiary, which increases the possibility of being selected, reduced or deleted.
