These people pursued Arbury because “it was a black man running down the street,” the prosecutor sums up.

In her closing argument, Linda Dunikoski, the chief prosecutor in the three men accused of the murder of Ahmaud Arbury, said the defendants had no reason to prosecute Mr. Arbury committed a crime that day – they just assumed he did it.

“All three defendants made assumptions about what happened that day,” she said. “And they made the decision to attack Ahmaud Arbury in the driveways because he was a black man running down the street.”

Ms. Dunikoski’s reference to Mr. Arbury’s race was significant because during her testimony last week she did not provide any examples of racist comments allegedly made by men, including William Brian’s claim that his defendant colleague Travis McMichael used racist insults immediately after the fatal shot at Mr. Arbury, which Mr. McMichael’s lawyers deny.

“So what’s going on here? You know what’s really going on here, ”she said in her closing argument. “Mr. Arbury was attacked.”

She added: “They shot him not because he posed a threat to them, but because he did not stop and talk to them. And they were going to make him – absolutely make – stop. “We’re going to aim a shotgun at you! It will make him stop. “

Mr Arbury was in a partially completed house on 23 February 2020, in the neighborhood of the defendants. After a neighbor saw him and called the police, Mr. Arbury left the house and ran. It was at this moment that Gregory McMichael, Travis McMichael’s father, saw Mr. Arbury and called his son, and the two men began to chase Mr. Arbury in a pickup truck. Mr. Brian, a neighbor, soon began to harass Mr. Arbury as well.

The men stated that they tried to detain Mr. Arbury as part of the arrest of a legal citizen. But Ms Dunikoski said that Georgian law requires a person to be present when a crime is committed or to have “direct knowledge” that a crime has been committed in order to carry out such an arrest. The law also stipulates that a person can make such an arrest if a serious crime has been committed and the suspect “flees or tries to hide,” but the detainee must have “reasonable and probable grounds” for suspicion.

Ms Dunikoski said the three men had never seen Mr Arbury inside the partially built house on the day of the incident. At best, she said, Mr. Arbury had committed the wrongdoing of trespassing. There is no evidence that Mr. Arbury ever took anything from a home that he had visited several times before.

“This is that giant burglar who just accidentally didn’t show up with a bag or any means to steal something, okay, or is he a jerk?” she said.

According to Ms Dunikoski, without a legal basis to detain Mr. Arbery, these people, in fact, committed crimes against him.

She explained to the jury all charges, including false confession, aggravated assault, felony and malicious murder. She referred to details in the witness statements about how three men in two pickup trucks were pursuing Mr. Arbury, who had fled from them on foot. She noted that Mr. Brian tried many times to use his car to stop Mr. Arbury, once pushing him off the road into a ditch. She mentioned that Gregory McMichael told investigators that Mr. Arbury was caught “like a rat” after being trapped by two trucks.

She also briefed the jury on aspects of the law that she said made all three guilty of crimes, including murder, even though only one of them pulled the trigger. She compared their actions to the actions of a football team working together to win.

“Everyone gets a Super Bowl ring,” she said.

Ms Dunikoski’s presentation lasted about an hour. She suggested that she would use her right to speak a second time after the defense had presented their closing arguments.
