The Federal Court of Buenos Aires decided that the federal court in charge of Judge María Eugenia Capuchetti continues to process a letter sent to the United States seeking information on the contents of the accounts of social networks linked to the three detained for attempted murder of Vice President Cristina Fernández de Kirchner.
Thus, the Court of Appeals settled the conflict that started between the court and the Federal Oral Court 6 that prepares the future trial of the three accused Fernando Sabag Montiel, Brenda Uliarte and Gabriel Carrizo, according to the resolution which has access Télam
The chambermaids Pablo Bertuzzi and Mariano Llorens allowed an appeal from the prosecutor of the case, Carlos Rivolo, after the arrival of a request for clarification from the US Justice, with an expiration date of the end of this month.
The Court of Appeals ordered that Capuchetti answer after the TOF6 refused to continue the procedure initiated by the judge during the investigation of the attempted murder on September 1, 2022.
“In that sense, it is known that the evidentiary measure in question is properly ordered while the proceedings are being processed in the investigation phase, before the trial rises,” concluded the Court of Appeals, and further, “it seems appropriate that, in light of the urgency, “in the case, the chief investigator who continues to send through diplomatic channels the request for the information requested, without prejudice to what is given at the end of the case that the content of the information contained in said social media accounts is sent.”
The judges warned that “in addition to the urgency to be seen is the seriousness of the institution of the fact investigated here, which, as we have mentioned on various occasions, must create methods of evidence that will be relevant and useful for examining the truth, without effort.”No hurry”.
Consequently, they reversed Capuchetti’s decision and ordered him to continue processing the warrant sent to the United States to request information on the content of social media accounts linked to the accused.
The Department of Justice of Argentina requested to obtain data on the ownership and content of the social media accounts used by Sabag Montiel and Uliarte.
