The First Section of the Provincial Court of Huelva will host from next Monday until October 23 the popular jury trial against two accused who caused the death of two people whose bodies appeared in a well in a farm in Cartaya in 2019. For them, the Prosecutor’s Office requested a sentence of 48 years in prison as alleged perpetrators of a crime of murder with treachery (23 years) and a crime of murder with treachery and cruelty (25 years).
This test was carried out after it was suspended in March – a date that was first shown – due to health problem of one of the lawyerstherefore the accused should be released.
So, according to the Prosecutor’s indictment, in the days before April 14, 2019, the accused JAMB and JMPP, both of whom have no criminal records, “planned to end the life of MBG”, where “they had . serious past conflicts involved, for the most part, in drug trafficking.
In this way, the Prosecutor’s Office showed that on April 14, 2019, one of the accused deceived MBG to accompany him in a farm located on a road in Cartaya “under the false pretext of seizing an undetermined amount of drugs that supposedly hidden there” and where one of the suspects was waiting for them “hidden and armed with his own shotgun.” alleged perpetrators of killing these peoplewhere they “intended to end MBG’s life by shooting him, taking advantage of his skills as an expert hunter”, and “with the intention of not giving this man any chance to react.”
Therefore, the document shows that at about 10:30 in the evening that day MBG arrived at the property accompanied by SVC, and the accused, who was waiting, “crouched a few meters away, in the dark and hidden among the plants, fired his shotgun, hitting the SVC. , confusing it in the darkness of the MBG, causing immediate death As a result of a single and accurate impact of the bullet received in the thorax causing a wound with the destruction of the vital thoracic centers, all without the victim having a chance to avoid such a fatal action, or detect an armed presence.”
After this, the defendant also shot MBG “without hitting, the gun ran out of bullets and approached the point where he was next to the other defendant, who ended his life by hitting him with one of them.” repeatedly hitting different parts of his body with the shotgun, causing the MBG to suffer greatly in this violent action as a result of the continuous impacts received by the metal barrel and the wooden stock of the weapon.
This man died “after receiving fatal blows to the skull and despite his trying to protect oneself from aggression because “he was hit with several blows that caused a fracture of the ulna and radius of his right arm – where he tried to protect himself from the impacts – as well as facial bruises, etc. damages” causing “at least 19 non-fatal injuries in the course of events and still alive”.
Ultimately, he died of “severe head trauma” after receiving, “at least, 14 effects focused on the occipital and parietal regions right which caused his skull to collapse while he was on the ground with multiple injuries and no possibility of defense.
The Prosecutor’s Office points out in its brief that “after committing the two deaths, the accused dragged the inert bodies of the two victims to a well in the same field where they threw them, hiding them from view well to third parties with greenhouse plastic,” as well as trying to “eliminate them.” any evidence that could accuse them of the murdered deaths” burning the car of one of the victims after it was taken to La Ribera, in Huelva, and they left the area.
Likewise, during their journey “they threw the mobile terminals they found on the bodies of the deceased into the Odiel estuary” with the “intention to erase all traces of their involvement in the death of the two you’re human.”
For all these reasons, the Prosecutor’s Office considers them guilty of a crime of murder with malice in relation to the death of SVC and of a crime of murder with malice and cruelty in connection with the death of MBG. As a result, he sought a sentence of 48 years in prison for each of them, 23 for the crime of murder with treachery and 25 with one involving cruelty. In addition, it requested that the defendant pay the relatives of the two victims an amount of more than 648,000 euros.
