Clifton Park – A drunk driver was driving with three children in his car as traffic stopped at Clifton Park on Saturday, state police said.
Brust, 40, of Wynantskill, was arrested and charged with one count of Leandra’s Law DWI, state police said.
State police said Troopers stopped Brust for a traffic jam on Fire Road in Clifton Park just after 8 p.m. Saturday.
When the cop spoke to Brust, the cop could smell alcohol from inside the car. The state police said the soldier also saw three children under the age of 16 in the vehicle.
State police said Brust was given a roadside sobriety test, which he failed and was taken into custody.
Brust was taken back to the barracks and provided a breath sample that came back to a 0.09 percent blood alcohol content. The legal limit to drive is 0.08 percent.
Brust was processed and later released to appear in court. The children were handed over to the family.
