Trump campaign loses arbitration case against Omarosa

Former Trump campaign and White House aide Omarosa Manigault Newman has defeated an arbitration case brought against her by the Trump campaign, alleging she made public comments and a non-disclosure with a book critical of former President Donald Trump. had violated the agreement.

In a summary judgment delivered Monday in favor of Manigault Newman, the arbitrator dismissed the Trump campaign’s claims, saying the NDA was “overwhelming, uncertain and unfair.” The decision is a rare example of a final and financial consequence by Trump in a legal battle against one of his personal or political enemies.

American Arbitration Association arbiter T. Andrew Brown said in the ruling that the terms of the NDA went “far beyond what could reasonably be expected to protect” the interests of the Trump campaign.

The arbitrator said that the agreement effectively imposed Manigault Newman “an obligation not to say anything remotely to Mr. Trump, his family, or the businesses of his or family members for the rest of his life.”

“Such a burden is certainly unreasonable,” the judgment said.

The arbitrator pointed to the decision in a federal court case in which another former Trump campaign employee, Jessica Denson, was seeking a decision to declare her campaign NDA unenforceable. In that case, a federal judge said in March that some provisions of the NDA were unenforceable.

The decision in Denson’s case was not precedent binding, said the arbitrator in the Manigault Newman case, but was nonetheless “persuasive and consistent with the principles of New York contract law.”

The Trump campaign sued in arbitration on the same day as the August 2018 release of Manigault Newman’s book “Unhinged: An Insider’s Account of the Trump White House,” his behind-the-scenes look at Trump working for him. The summary judgment stated that since Manigault Newman had won the arbitration case, she could now pursue attorneys’ fees.

“Frankly, I am very pleased with this decision,” Manigault Neumann said in a statement. “Donald has used this type of annoying lawsuit to intimidate, harass, and bully for years! Finally, the bully has met his match!”

In a statement provided to CNN by a Trump spokesperson, the former president did not note the merits of the decision, but criticized Manigault Newman personally.

“No one in her life has done more for Omarosa than a man named Donald Trump,” he said. “Unfortunately, like some others, she forgot everything – which is fine with me!”

Manigault Newman’s book, previously known for its polarizing character in NBC’s “The Apprentice,” painted a damaging portrait of the former president. In it, she describes a man who is mentally weak, racist and vulgar, charismatic but emotionally abusive, supportive and overseen by a collusive cast of family members whose varied goals rarely include the betterment of the nation. Manigault Newman insisted that her firing from the White House was because she knew too much about a possible audio recording of Trump saying a racist adjective he claims was the subject of deep rift between the campaign.
